Oxford Immunotec Global PLC (Nasdaq:OXFD), a global, high-growth diagnostics company focused on developing and commercializing proprietary tests for the management of underserved immune-regulated conditions, today announced a decision of the U.S. District Court for the District of Massachusetts in the Company's patent infringement lawsuit against Qiagen, Inc., Quest Diagnostics, Inc. and Laboratory Corporation of America Holdings on the Company's motion seeking to enjoin Qiagen from promoting its QuantiFERON-TB Gold Plus (QFT-Plus) product to new customers in the U.S. Although the court denied the Company's motion because it believed the Company was not likely to suffer irreparable harm from QFT-Plus during the few months remaining before trial, it found that the Company was likely to prevail on the merits of its claims at trial and that Qiagen had not shown that it was likely to succeed on its subject matter, prior art or non-infringement objections. The court further noted that if the Company "prevails at trial, it is likely that the infringing aspects of the QFT Plus will be permanently enjoined."

"While we are disappointed that the court did not grant a preliminary injunction prohibiting the sale of Qiagen's QFT-Plus product in the U.S. before trial, we are encouraged by the court's rulings on the issues of validity and obviousness," said Dr. Peter Wrighton-Smith, Chief Executive Officer of Oxford Immunotec. "We continue to look forward to the further defense of our patents at the upcoming trial in January."
